Application
These general terms and conditions of sale (hereinafter: “T&Cs”) apply to sales transactions concluded by the Hotel (hereinafter: “the Company”) with the Customer.
They cancel and replace any previous version that may have been put online and / or accepted by the Customer.
These T&Cs apply to any use of the site, in particular to the marketing by Internet and telephone of all services offered on the Site by the Company.
It is therefore imperative that the Client carefully read these T&Cs. In particular, he is advised to download and/or print them in order to keep a copy of them on the day of his order as they are likely to be modified, it being specified, however, that such modifications will not apply to orders for Services made previously.
The General Terms and Conditions of Sale may be supplemented by special terms and conditions of sale appearing on the description of the service as well as by the terms and conditions of sale of the service providers, accessible either on their Website or on site.
Capacity
The Client acknowledges having the capacity to contract, i.e. being of legal majority and not being under guardianship or trusteeship.
The Customer also declares that he uses the Site in accordance with these T&Cs, in his own name and on behalf of all the beneficiaries of the services ordered by him on the Site of which he acknowledges being the agent (hereinafter: the “Beneficiaries”) and against whom these T&Cs shall be enforceable.
The Client is financially responsible for the use of the Site made both in his own name and on behalf of the Beneficiaries, unless he can prove fraudulent use not resulting from any fault or negligence on his part.
The Client guarantees the truthfulness and accuracy of the information provided by him in his name and on behalf of all the Beneficiaries using his data on the Site.
The Company reserves the right at any time not to contract with a Client who would make fraudulent use of the Site or who would contravene these T&Cs.
In this respect, the terms of article 313-1 of the French Penal Code are recalled: “The fraud is the fact, either by the use of a false name or a false quality, or by the abuse of a true quality, or by the use of fraudulent maneuvers to deceive a natural or legal person and thus determine it, to its prejudice or to the prejudice of a third party, to give funds, securities or any property whatsoever, to provide a service or to consent to an act operating obligation or discharge. Fraud is punishable by five years’ imprisonment and a fine of € 375,000“
Right of Withdrawal
Pursuant to the provisions of article L. 121-21-8 of the French Consumer Code, the services offered on the Site by the Company are not subject to the right of withdrawal provided for in articles L. 121-21 et seq. of the French Consumer Code regarding distance selling.
Consequently, the services ordered on the Site are exclusively subject to the cancellation and modification conditions provided for in theseT&Cs and the Customer may not invoke the right of withdrawal.
Prices and Pricing Conditions
Prices are indicated in Euros. VAT is included in all rates. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically passed on to the prices indicated on the date of invoicing.
Rates are per room for the number of persons indicated and according to the selected period.
The prices indicated only include the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added the additional services provided by the Hotel during the stay and, if necessary, the tourist tax and/or the city tax.
The prices and pricing conditions mentioned on the Site are subject to change at any time by the Hotel without prior information or notice. Only the price indicated in the Company’s booking confirmation is contractual.
CONDITIONS FOR THE ULTRA-FLEXIBLE RATE :
– A valid credit card is required upon reservation as a guarantee
– Free cancellation until noon time on arrival day (12h00, mid-day on day of arrival, Paris time)
– In case of late cancellation, late modification, no-show or early departure, the first night will be charged and the rest of stay automatically cancelled
CONDITIONS FOR THE FLEXIBLE RATE :
– A valid credit card is required upon reservation as a guarantee
– Free cancellation until noon time one day prior to arrival day (12h00, mid-day prior to arrival day, Paris time)
– In case of late cancellation, late modification, no-show or early departure, the first (and potentially the second night depending on cancellation time) will be charged and the rest of stay automatically cancelled
CONDITIONS FOR THE NON REFUNDABLE NON CANCELLABLE RATES :
– Prepayment for the full amount of stay is required upon reservation
– As soon as the reservation is processed and paid, it is non cancellable, non changeable (in terms of guest name or booking date) and non refundable. The hotel keeps then all sums paid for the booking. – In case of no-show on the first night, the hotel will contact the client directly, and reserves the right to cancel the whole stay if guest does not show up the second day before noon (mid-day, Paris time).
Hence, the full amount of stay will also be kept by the hotel and invoiced as cancellation fees.
GROUP CONDITIONS:
– Any booking for more than 5 rooms travelling together is considered as a group booking
– Promotional codes are non valid and non applicable for any request of more than 5 rooms travelling together

Online Booking Terms and Conditions
When making his reservation, it is mandatory that The Customer :
– fills in the identification form on which he will indicate all the requested information,
– fills in the online reservation request giving all the references of the products or services chosen, and specifically the information requested to guarantee the reservation (credit card)
– validates his reservation after having checked it and accepted the conditions linked to the rate selected
Confirmation of the reservation implies acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to use one’s own terms and conditions of purchase or other conditions.
All the data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The Company shall send the Client, by e-mail and/or SMS, confirmation of the registered order.
The reservation is firm and definitive only after receipt of the confirmation sent to the Client by the Company.
The rates, terms and conditions of a reservation are intended for the sale of hotel rooms in accordance with their primary purpose (accommodation). The hotel reserves the right to modify the rates, terms and conditions, or simply to cancel the reservation, if the rooms are used for other purposes such as photo shoots, film shoots, showroom, or interviews…
Cancellations and/or changes to reservations may be authorised according to the rate plan chosen by the Customer, and specified in point IV.
Booking guarantee and terms of payment
GUARANTEE POLICY:
Any individual booking must be guaranteed with :
– either a total prepayment of the stay, by bank transfer or credit card before Customer checks in;
– either detailed information of the Client credit card, the transmission of these information being made by secure means.
Credit card information must include : cardholder’s name, valid credit card number, expiry date and the cryptogram. A credit card debit authorization form will then be sent to the Client for signature.
Please also note that the hotel reserves the right to issue a pre-authorization for the amount of stay at any time prior to arrival to guarantee and secure the reservation.
MEANS OF PAYMENT :
The hotel accepts payment in cash (euros only), by credit card or by bank transfer (transfer fees are to be paid in
full by the guest).
The credit cards accepted by the hotel are as follows: Visa, Mastercard, American Express, Diners Club and JCB.
Payments by bank check or holiday check are not accepted.
Payment by personal check or holiday voucher are not accepted.
Alternative hosting solution
In the event of non-availability of the Hotel or in the event of force majeure, the Hotel reserves the right to book the Customer stay, totally or partially, in another hotel of an equivalent or higher category, offering services of the same nature.
The transfer will then be at the expense of the Hotel , who may not be sought in payment of any additional compensation.
Force majeure
Force majeure is understood to mean any event outside the parties that is both unforeseeable and insurmountable and that prevents either the client or the hotel owner from fulfilling all or part of the obligations stipulated in the contract.
This is particularly the case in the event of strikes, insurrection, riots, prohibitions issued by government or public authorities.
It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party shall bear the costs arising therefrom.
In particular, the Customers shall bear solely any additional costs that may be incurred to enable the trip to continue, following the occurrence of a case of force majeure.
Claims
All complaints should be addressed to the following address: HOTEL CHAVANEL- 22 RUE TRONCHET- 75008 PARIS- FRANCE, within 15 days following the departure of the stay which is the subject of such claim. After this period, no claim can be taken into account.
Data processing and liberties
The Company offers wifi internet access. The Customer undertakes that the computer resources made available to him/her will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright, by a related right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the intellectual property code when such authorisation is required.
The hotel has a video surveillance system in the common areas of the building. (Law No. 95-73 of 21/01/95 and Decree No. 96-926 of 17/10/96. To exercise the right of access to the images, please contact the hotel General Manager.
Responsibilities
The Company declines all responsibility in the event of theft, loss or damage to the effects belonging to the clients during their stay.
The Client shall be held responsible for any damage, any deterioration, any act of vandalism that may occur due to the occupation of the premises and/or due to the participants and/or the staff in their charge, both to movable, decorative and immovable property belonging or not belonging to the hotel. As a result, the Company has every
right to ask the Client to leave the establishment without any indemnity and without any reimbursement for the current stay, and to reimburse the damage caused by these acts.
The Company, in the process of selling online, is only bound by an obligation of means. Its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service rupture, or other involuntary problems.
Applicable law
These General Terms and Conditions of Sale are governed by French law. The same is true for the rules of substance as for the rules of form. Disputes shall fall within the exclusive jurisdiction of French courts.
